Toys & Tales is a Toy Renting and online retail Library where customers create an account and can request the subscription of toys based on the appropriate age and requirements by placing a subscription Order at their website
www.toysandtales.in or in Mobile Application. We provide toys on rent for a particular period of time, which is confirmed by the customers at the time of checkout and the same is shipped to the delivery address mentioned by them or picked up directly by the customer.
The use of the website and Mobile Application is bound by the following terms and conditions. The said terms & conditions mentioned below is a legally binding and enforceable contract between Toys & Tales and you. You agree that by way of using the website and Mobile Application, you are voluntarily accepting to be bound by the below terms and conditions.

As remarked above, availing of services offered by Toys & Tales is voluntary and shall be deemed as acceptance of the terms and conditions mentioned herein.
ELECTRONIC RECORD
The Terms & Conditions should be considered and clearly understood as an electronic record under the provisions of Information Technology Act, 2000 as amended. The terms and conditions are drafted as per the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. Any subsequent changes and clause modifications will be intimated accordingly and ratified with mutual consent before implementation
USING OUR SERVICES
Toys & Tales is a toy rental and online retail Company which receives information from customers when they register on the website or Mobile Application or place a subscription, or reach out in respect of any query. We collect information relating to details of the customer’s name, name and age of the child, email, address and phone number.
USER REGISTRATION
Toys & Tales requires its customers to register with the website or Mobile Application using a username and password and the details provided thereunder are maintained by them in strict confidentiality. Once the user profile is set up, the customers may commence use of the website’s or Mobile Application’s services to checkout toys on rent and sale. By signing in with the website or Mobile Application, you present that:
- 1. you are a major and that you are registering on behalf of a minor person, you are authorized to register for the Service in the capacity as a parent/ guardian / caregiver;
- 2. The information which is provided by you is true and that you have not misrepresented any information.
You expressly agree and undertake that Toys & Tales at any time can suspend or terminate your account and refuse any and all current or further use of the same if it determined or has reason to believe that any information provided by you is untrue or inaccurate.
Please note that it is your responsibility to keep your user name and password safe. Toys & Tales shall not be responsible for unauthorized access to your personal information saved therein or any alteration to your data. Your username and password are personal to you and under no circumstances may you allow any others to use your username and/or password. Toys & Tales shall not be liable for any harm caused or any loss related to the theft or misappropriation of your username and/or password, disclosure or your username and/or password, or your authorization of anyone else to use your username and/or password.
USE OF CUSTOMER INFORMATION
Toys & Tales uses your information (i) to provide age-appropriate content for future use; (ii) personalise the subsequent requirements and your site experience and (iii) helps to improve our products and services based on your customer service response forms; (iv) to quickly process your transactions; (v) internal record keeping and (vi) any contest or promotional offers based on your earlier transactions. The user if does not want to share the information, they can or decline or opt out.
Toys & Tales may, at reasonable times, contact you for market research purposes to enhance the products/services provided by us to the customers.
CUSTOMER PRIVACY POLICY
Toys & Tales ensures that the privacy of the customers is its priority and takes utmost reasonable precautions to ensure the private information provided by the customers is not used beyond its scope. The information so collected from the customers is accessible only to a limited number of people who have special access to such systems and have been bound to keep the information confidential. The website or Mobile Application provides a secure server to the customer while collecting such private information.
DISCLOSURE OF INFORMATION TO THIRD PARTIES
Except as mentioned hereunder, Toys & Tales does not divulge personal information of customers to unauthorised third parties and without advance notice. The expression ‘Third Parties’ does not include the website or Mobile Application hosting partners and courier companies who aid in operating the business and provide assurance of confidentiality. While Toys & Tales takes reasonable and appropriate measures to ensure confidentiality of the customer information, it shall not be liable for any damages that may result from the misuse of your personal information by third Parties. Release of personal information is purely restricted to requirements or compliance with law, to enforce site policies or to protect ours or others rights, property, or safety. Information of customers that do not qualify as identifiable information may be provided to other parties for marketing, advertising or other users.
PRODUCT SAFETY
The customers are hereby informed that TOYS & TALES is not responsible for any use by them of any toys except as intended in the product information. The products are intended for the age group mentioned in the product description and any harm caused to the children, when using the products outside the intended manner shall not accrue any liability to Toys & Tales. Toys & Tales shall not be responsible for any unintended injury due to usage of the toys by the children and it is at the own risk of the parents/caregivers to ensure children’s safety. We shall send age-appropriate toys as requested and confirmed by the customers.
AGREEMENT TO MAINTAIN
The customer agrees to take care and maintain the toy in the delivered condition and agrees to pay for damages in case of damage.
INTELLECTUAL PROPERTY
Using our website or Mobile Application does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from us or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our website or Mobile Application. The Contents of the website, Mobile Application and all other intellectual properties used in the website or Mobile Application are owned by Toys & Tales. The trademarks mentioned in the website or Mobile Application solely belong to Toys & Tales. By allowing access to you or any third party does not convey any ownership rights in website or Mobile Application. You shall not copy, modify, translate, distribute, reproduce or reverse engineer any content of the website or Mobile Application.
INDEMNIFICATION
You agree to defend, indemnify and hold harmless Toys & Tales and any of their respective officers, directors, employees, agents and representatives from any and all claims arising out of your breach of any of these terms and conditions.
REPRESENTATION BY THE USER
The user agrees not to copy, modify, reverse engineer, decompile, disassemble, create derivative works of the Software nor attempt to locate or obtain its source code.
RESPONSIBILITY OF THE COMPANY
The responsibility of Toys & Tales for the services and transportation of goods shall be deemed fulfilled upon delivery of the consignment to the Delivery Agents with the appropriate address mentioned by the customers at the time of checking out.
Toys & tales takes responsibility to deliver the toys and books as described beforehand. We will inform if a part is missing or a minor damage is there, which doesn’t affect the working of the toy or book beforehand.
SHIPPING AND RETURNS:
Toys & Tales undertakes to ship the products approved by the customers within 1 to 3 days of placing the Order, except under reasonable circumstances that incapacitate the proper shipping of the package. You undertake to return the toys within the duration requested by you at the time of checkout, by placing a request for return and our Agents shall ensure collection of the same from you at the earliest instance subject to the terms mentioned hereunder.
DAMAGE TO THE PRODUCTS
You undertake to return the toys in the same condition as was received by you at the time of delivery. Once a request for return is placed, our Agent shall collect the toys from you after a thorough verification of the condition of the toys.
In the event of minor damage or unintended wear and tear and the product is repairable, only actual repair cost will be charged. In case of missing parts, if the spares are available, only actual spare cost will be charged. If the product is beyond repair/spares are not available, depreciated cost of the toy will be charged. In the rare event that a toy is lost or stolen while in the care of the customer, the customer will be charged the full retail value for the replacement of the toy after deducting the depreciation charge.
REFUNDABLE DEPOSIT
Refundable deposit will be returned back after verification of the condition of the toys. This applies only when the subscription is discontinued or terminated by us.
If after the set subscription period is over the user can switch to a different subscription plan and the refundable deposit will be taken/ given back according to the plan rules.
MODIFICATION OF TERMS & CONDITIONS
The above-mentioned terms and conditions may be changed, deleted or updated at any time without notice by Toys and Tales.
SEVERABILITY
If it turns out that a particular term is not enforceable, this will not affect any other terms.
JURISDICTION
Any dispute arising out of this terms & conditions shall be exclusively filed at the Court at Hyderabad only
APPLICABLE LAW
The Applicable Law in relation to any dispute arising will be the prevailing Law of India.
Toys & Tales has the right to change/revise/modify the Rental Prices at any time without giving prior notice. However, in case of modification of prices, the same will be applicable to existing customers only at the end of validity period of current toy.
All products in circulation will continue to remain the property of Toys & Tales.
Any change in address needs to be communicated to Toys & Tales.
Members are not allowed to exchange toys with friends or other family members even if they are members of Toys & Tales. All toys must remain at borrowers home.
Delivery/Return Instructions
Customers are requested to count the number of piece(s)/ check the quality of the toy at the time of delivery. In case of any disconnect please get the same recorded on the “Issue Form” available with the Delivery Boy. The issue form will be considered as final at the time of return of item as well.
The Home Delivery Agent of Toys & Tales will also check each product thoroughly at the time of return to check for missing parts and whether the returned product is in the same condition as it was delivered as per the “Issue Form”. Members are requested to ensure that the items returned are cleaned for any visible debris (i.e. food, dirt etc.) before returning back.
Any complaint regarding the functionality of the borrowed item must be received within 24 hours of delivery for it to be considered as a valid complaint. Appropriate measures will taken by Toys & Tales team to rectify or exchange the item without any additional charge to the member. However, under no circumstances will a compliant regarding an item be acceptable beyond 24 hours of delivery, the same may be charged to the member at the discretion of the company.
Post return all items go through rigorous Quality Check by the Quality team. In case any damage/missing part/functionality issue is highlighted, it will be intimated to the member by the next working day through email / sms. In case of missing part the member can return the same within 7 days failing which an additional charge will be levied depending on the repairability/availability of the missing item. In case the item is beyond repair depreciated cost of the toy will be charged and the same will be intimated to the member through email /sms.
Please make sure to return all the pieces of the toy at the time of return
Cancellation:
In the situation of any cancellation of the order 2 days prior to the delivery, there will be full refund in case of payment made, any cancellations post that will be charged for 1day.
In case the client is not happy with the toy within 24 hours of delivery, only delivery charges will be taken, 100% of the rental charges would be refunded. Any cancellation post 24hours of delivery will be chargeable.
